Andrew Davis Photography – Terms & Conditions
These Terms & Conditions (“T&C”) set out the agreement between Andrew Davis Photography (“Photographer”) and the client (“Client”). By booking services, the Client agrees to be bound by these T&C. No variation or modification shall be effective unless agreed in writing.
Section 0: General Terms (All Clients)
0.1 Agreement & Scope
This contract covers all photography services provided by Andrew Davis Photography, including corporate, commercial, studio, and wedding services.
The scope of services, deliverables, timelines, and fees will be confirmed in writing prior to the shoot.
0.2 Booking & Payment
A booking fee secures your date and is non-refundable unless otherwise stated.
Full payment must be received before images or services are delivered.
0.3 Late Payment
Invoices are due as stated in the contract. While we understand that payment schedules can vary, overdue invoices may incur a late fee of 2% per month on the outstanding balance, or a reasonable fee agreed in writing. This is intended to encourage timely payment and cover administrative costs.
0.4 Copyright & Usage
All images remain the copyright of Andrew Davis Photography.
The Client is granted a license to use images as agreed for the type of service booked. Selling, publishing, or any commercial use beyond the agreed license is prohibited without written permission.
0.5 Liability & Force Majeure
Liability is limited to the total contract value.
Neither party is responsible for indirect or consequential loss.
The Photographer may alter schedules or cancel due to causes beyond their control (e.g., illness, equipment failure, extreme weather, or other unforeseeable events).
0.6 Complaints & Mediation
Complaints must be raised in writing within 21 days of receiving images.
In the event of an unresolved dispute, the parties may seek mediation at the client’s expense, with the decision considered final and binding.
0.7 Delivery & Storage
Delivery timelines will be confirmed per project.
Clients are responsible for downloading and backing up all images. The Photographer retains copies for up to 5 years from the shoot date.
Final images are delivered via a secure online gallery, accessible for 1 year from the date of posting. Clients may extend access at £3.99 per month or £39.99 per year.
0.8 Travel & Expenses
Clients will reimburse agreed travel and accommodation costs. Mileage is charged at £0.50 per mile for distances exceeding the included travel.
Section 1: Corporate & Commercial Photography
1.1 Scope & Deliverables
The Photographer will deliver images in agreed formats and resolutions, edited or unedited as specified in the contract.
Optional services (retouching, branding edits, multi-location shoots) are charged at the standard rate unless otherwise agreed.
Completion of a project occurs when the client receives the images, is satisfied with them, and all work is finished.
1.2 Payments & Cancellations
Payment schedule is agreed per project.
Deposits are required for recurring or multi-shoot bookings; one-off projects are treated individually.
Cancellations must be in writing; fees may apply depending on notice period and project status.
1.3 Commercial Usage License
Images are licensed for the agreed use (website, marketing, social media, print, etc.). Temporary or limited-use projects are licensed for the same period as standard projects, unless otherwise agreed in writing. This allows clients to re-use images later if required.
The Photographer retains copyright and the right to display images in portfolio or marketing materials unless the client opts out.
Clients may not resell, sublicense, or significantly modify images without written permission. Minor edits such as cropping, resizing, or branding overlays are permitted.
1.4 Client Responsibilities
Clients must provide access, permissions, approvals, and any necessary authorisations or permits.
Clients must ensure health and safety compliance for all locations and events.
Delays caused by venue restrictions, third parties, or other external factors may affect timelines.
1.5 Turnaround & Availability
Unless otherwise agreed, final images are delivered within 1–7 business days.
Delivery timelines assume the Photographer is available. Holidays, illness, or other commitments may delay delivery, and the client will be notified promptly.
Specific delivery dates will be confirmed in writing per project.
1.6 Liability
The Photographer’s liability for damage or injury during corporate shoots is limited to the contract value. Clients are responsible for ensuring a safe working environment for all parties.
Section 2: Studio Photography (Non-Wedding, Non-Corporate)
2.1 Booking & Payment
Studio sessions require a booking fee; balance due prior to delivery of images.
2.2 Deliverables
Images delivered in agreed formats. Additional services (prints, canvases, retouching) may incur extra charges.
2.3 Usage
Images are for personal use unless otherwise agreed. Commercial usage requires a separate license.
2.4 Cancellation & Rescheduling
Studio sessions may be rescheduled with reasonable notice; late cancellations may incur fees.
Section 3: Weddings & Personal Events
3.1 Booking & Payments
Booking fee secures the date and is non-refundable.
Balance due 28 days prior to the wedding.
3.2 Coordination & Permissions
Clients are responsible for providing information to coordinators and obtaining permission for all locations.
3.3 Attendance & Liability
In case of unforeseen absence, the Photographer may appoint a qualified substitute.
Liability for total photographic failure or missed images is limited to the contract value.
3.4 Delivery & Albums
High-resolution images delivered within 2–3 months.
Clients approve albums/images within 12 months; late approvals may incur extra charges.
3.5 RAW Files & Retouching
RAW files are available at £25 per image (minimum 20 images).
For larger purchases (minimum 50 images), a discount may be negotiated prior to the shoot.
Additional retouching outside standard editing is charged at £15 per image.
3.6 Client Cooperation & Venue Rules
Clients agree to cooperate and allow the Photographer precedence over guests.
Photographer cannot be held responsible for missed images due to guest interference, venue restrictions, or delays.
3.7 Cancellation & Rescheduling
Written notice required.
Cancellation less than 12 weeks prior: 75% of package payable.
Deposits may be transferable if cancelled at least 12 weeks prior.
Date or venue changes must be confirmed in writing; availability cannot be guaranteed.
3.8 Safety & Legal Compliance
All events must comply with current legal requirements. Non-compliance may result in the Photographer leaving the premises; fees forfeited.
3.9 Portfolio & Display
Images may be used in portfolio, marketing, exhibitions, or competitions in accordance with our Privacy Policy. Clients may opt out at booking.

These Terms & Conditions apply to all clients. The most recent version supersedes any prior agreements unless stated otherwise.
